A few important details that you should know

Orders

We will take all reasonable care (within our power to do so) to keep the details of your order and payment secure. However, in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from the Website.

Contract creation

A contract is created between you and us as follows:

◾You place the order for your products on the Website by pressing the confirm order button at the end of the checkout process. You will be guided through the process of placing an order by following a series of simple instructions on the Website

◾We will send you an order acknowledgement email detailing the products you have ordered. This is not an order confirmation or order acceptance from The Seaside Company.

◾Order acceptance and the completion of the contract between you and us will take place on the despatch to you of all products ordered unless we have notified you that we do not accept your order, or you have cancelled it in accordance with the instructions.

Non-acceptance of an order may be a result of one of the following:

The product you ordered being unavailable from stock
Our inability to obtain authorisation for your payment
The identification of a pricing or product description error
Your not meeting the eligibility to order from The Seaside Company
Our belief that the order is not bona fide

If there are any problems with an order, you'll be contacted by us.

Cancellation of an order

The Consumer Contracts Regulations 2013 offer you the following cancellation rights when buying online or by telephone.

◾You are entitled to cancel your contract if you so wish, provided that you exercise your right no longer than 14 days after the day on which you receive the goods or services.

◾Your right to return products does not apply to goods made to your specification, that have been clearly personalised or which by reason of their nature cannot be returned or are liable to deteriorate or expire rapidly.

◾If you wish to exercise your right of cancellation, you are obliged to retain possession of the goods and take reasonable care of them.

◾To exercise the right to cancel, you must inform us of your decision to cancel your contract by a clear statement, including details of your name, geographical address, details of the order you wish to cancel and, where available, your phone number and email address.

◾If you decide to cancel, you should return the goods to us at your cost within 14 days of such cancellation and we will reimburse to you (by the method used to pay for the original transaction) the amount in relation to goods to which cancellation rights apply.

◾We may make a deduction from the reimbursement for loss in value of any goods supplied, if the loss is the result of unnecessary handling by you. We will make the reimbursement no later than 14 days after the day we receive back from you any goods supplied.

Delivery timescales

We make every effort to deliver goods within the estimated timescales, However delays are occasionally inevitable due to unforeseen factors. Please see delivery & returns for more information.

Payments

Payments must be made in £ Sterling only. You can use Visa, MasterCard, Maestro, Visa Debit, Solo, Delta, EuroCard, JCB, Laser, Electron. When you have completed your selections you are automatically transferred to the Sage Pay secure online payments server.

Overseas payment

We only currently accept online payment from cards issued by UK banks. Please contact us if you'd like to place an order but have a card issued by a non-UK bank.

Payment

The Seaside Company will only take payment from a customer once it has checked the validity of the order. If the product is not currently in stock, The Seaside Company will notify the customer and either inform the customer when the product will be in stock, offer an alternative product or cancel the order and issue a refund.

Acceptance of order

Placing an order through the website is notification that you agree with our terms and conditions. These terms and conditions will be updated occasionally, please check them before making your purchase.

We have made every effort to display all our products as accurately as possible. However as colours and images vary depending on your own monitor and browser we cannot guarantee that products will be exactly as seen on your monitor. Most products have been described with sizes/lengths/weights given as accurately as possible.

Price

All prices are quoted in £ Sterling and include standard UK VAT where applicable. All prices are exclusive of postage and packaging, unless otherwise stated. You will be given the total price of the transaction before you complete your purchase. There are no hidden extra costs. In the rare event that an item is incorrectly priced on the web site, The Seaside Company reserves the right to not supply that item at said price. The normal price will be offered instead.

Passing of property

The Seaside Company shall retain legal title to the products until all payment has been made in full by the Customer.

Acceptance of an order

The Customer shall inspect the goods within a reasonable time after their receipt. (This does not however affect the customer's statutory rights).

Privacy & Security

Secure online shopping
When you place an order it's done using the Secure Socket Layer (SSL) encryption method; your details are encrypted before the information goes from your computer to ours.

When this is happening you'll see a little padlock symbol at the bottom of the browser - this means that your details are totally safe from prying eyes and that only we can see them. (Some browsers don't have this symbol; if the address of the web page starts with https, this also confirms you're secure). This method is the recognised standard for secure transactions.

Privacy policy

Personal information is private so we treat it with the highest standards of security and confidentiality.

We never sell or give any information we have about you to any other company. You can rest assured that your credit/debit card and personal information are safe with us.

Returns Policy

We hope you like the product purchased from ourselves. However, if any item is not what you require then please notify us in writing (email/post) within 14 working days of receipt, stating the reason for return. Returns must be received by us within 30 days of receipt of your order and include the original packaging and labels where possible. You must also include your receipt as proof of purchase. The customer is responsible for the cost of returning any unwanted items.

We will then issue you with either a refund or allow you to exchange the item for something else instead. You have a statutory duty to take reasonable care of any item in your possession and in returning the item. We advise sending items back via recorded delivery for your own proof of delivery.

Please note: We will refund the price of the item to the purchaser or exchange the product once it is received by us. If we find that the product has been returned to us and is either used or damaged, we reserve the right to refuse a refund on the item, or deduct up to 50% of the original selling price from the refund amount.

Refusal to accept parcel at the designated delivery address
If a customer refuses to accept delivery of a parcel at the designated delivery address (for whatever reason) and has not already informed us of their right to cancel, then we will refund the cost of the goods less any return delivery charge imposed by the courier company.

Return of parcel due to failed delivery
If a parcel is returned to us by the courier following repeated failed attempts to deliver then we reserve the right to deduct the cost of the return delivery charge from any refund amount. A failed attempt will result from the customer not being at home and not having given alternative delivery instructions. It will also result from a customer failing to respond in a timely manner to attempted delivery cards left by the courier.

Damaged/faulty/incorrect goods

Please check your goods on delivery. If items do arrive damaged/faulty please let us know immediately and return the items within 14 days of receipt. We suggest you post them back to us using recorded delivery. The same procedures apply on the rare occasion the goods are incorrect. Note that we will refund the extra return delivery charge on items that are damaged, faulty or incorrect. If you do not inform us within 7 days, then we will have no liability for items said to be damaged, faulty or incorrect on delivery.
